Gaphed ("Gaphed", "we", "us") provides the Gaphed web application, a client and prospect management tool for freelancers. By creating an account or using the service you enter into an agreement with Gaphed.

By registering for, accessing, or continuing to use Gaphed you agree to these terms. If you use Gaphed on behalf of a business, you confirm you have authority to bind that business. If you use it as an individual, you confirm you are of legal age in your country.

You must provide accurate registration details and keep them up to date. You are responsible for keeping your login credentials confidential and for all activity that happens under your account.

You must not misuse Gaphed. In particular you must not use it for anything unlawful, for fraud, spam or unsolicited bulk messaging that breaks the rules of the platforms you contact people on, to infringe anyone's intellectual property, or to interfere with the security of the service (including malware, probing, scraping or unauthorised access attempts).

You keep ownership of the prospect records, messages, contracts, proposals and invoices you create. You grant us a limited licence to host and process that content solely so we can provide the service to you. You are responsible for having the rights to any content you upload and for complying with data protection law when you store details about your clients and prospects.

Gaphed, its software, design, documentation and branding remain our property. You receive a limited, non-exclusive, non-transferable right to use the service within the plan you have selected. You must not reverse engineer, resell, redistribute or circumvent the technical limits of the service.

Gaphed offers a Free plan with usage limits and paid Pro plans billed monthly or yearly. Payment, billing, taxes, currency, cancellations and refunds are handled by our reseller, Paddle, and are governed by the Paddle Buyer Terms. Paid plans renew automatically at the end of each billing period until cancelled. You can cancel at any time from Settings → Subscription; access to Pro features continues until the end of the period you have already paid for.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

We work to keep Gaphed available and reliable, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using Gaphed and delete your account at any time. After termination you may export your data for a reasonable period, after which it may be deleted.

To the extent permitted by law, our aggregate liability is limited to the fees you paid in the twelve months before the claim. We are not liable for indirect or consequential loss, including lost profits, lost data or lost goodwill. Nothing excludes liability for fraud, death or personal injury where the law does not allow it.

You indemnify us against claims arising from your content, your unlawful use of the service, or your breach of these terms.

You may not assign this agreement without our consent; we may assign it as part of a merger or acquisition. Neither party is liable for delays caused by events beyond their reasonable control. These terms are governed by the laws of the seller's jurisdiction, and disputes are subject to the courts of that jurisdiction.
